These Terms of Service ("Terms") govern your access to and use of Starlit Magic, including the beta program, website at starlitmagic.com, and any related services (collectively, the "App"), developed and operated by AliKat Digital ("we," "us," or "our"). By signing up for the beta, downloading the App, or using any of our services, you agree to be bound by these Terms.
By accessing or using Starlit Magic, you confirm that you are at least 13 years of age (or the age of digital consent in your jurisdiction), that you have the legal authority to enter into these Terms, and that you agree to comply with them in full. If you do not agree, please do not use the App.
If you are accessing Starlit Magic through the TestFlight beta program, you acknowledge that:
Subject to these Terms, AliKat Digital grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial use. You may not copy, modify, distribute, sell, sublicense, or reverse-engineer any part of the App.
You may sign in to Starlit Magic using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to notify us immediately at [email protected] of any unauthorized access to your account.
Starlit Magic offers a free tier and an optional Premium subscription. Subscriptions are billed through the Apple App Store and are subject to Apple's payment terms. All pricing is displayed in USD unless otherwise stated. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Cancellations can be managed through your Apple ID account settings. We do not offer refunds outside of those required by Apple's refund policy or applicable law.
You agree not to use Starlit Magic in any way that:
Violations may result in immediate termination of your access, with or without notice.
Starlit Magic includes community features that allow users to share tips, photos, and park reports. You retain ownership of content you submit, but grant AliKat Digital a worldwide, royalty-free license to use, display, and distribute that content within the App. You are solely responsible for the content you post. We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be harmful, inappropriate, or inaccurate.
Wait time data, park hours, dining information, and other park data are sourced from third-party providers and publicly available sources. While we strive for accuracy, we cannot guarantee that this information is always correct, complete, or up to date. Starlit Magic makes use of Apple Maps for map functionality and may link to third-party Disney fan news sources. Your use of third-party services is governed by those parties' own terms and policies.
Starlit Magic is an independent application and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with The Walt Disney Company or any of its subsidiaries. All Disney-related names, trademarks, and intellectual property are the property of The Walt Disney Company. References to Disney parks, attractions, and venues are for informational purposes only.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, secure, or that any data will be accurate. Your use of the App is at your sole risk.
To the fullest extent permitted by applicable law, AliKat Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, personal injury, or property damage, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid to us in the twelve months preceding the claim, or $10 USD, whichever is greater.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, notify you by email or in-app notification. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
You may stop using the App at any time. We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App immediately ceases, and provisions of these Terms that by their nature should survive will remain in effect.
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York.
